  1. INTRODUCTION

These Terms and Conditions (“Terms”) govern the access to, use of, and purchase of products from the Astorare website (the “Website”) operated by Aspetra Limited, a company incorporated in Hong Kong (“we”, “us”, or “our”). By placing an order on this Website, you agree to be bound by these Terms. Our products are intended for personal, end-consumer use only.

  1. ELECTRONIC COMMUNICATIONS

When you visit the site or send us e-mails, you are communicating with us electronically. You consent to receive communications from us electronically. You agree that all agreements, notices, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

  1. ORDER ACCEPTANCE AND CONTRACT FORMATION

The display of products on the Website does not constitute a binding offer. A contract is only formed when we credit your payment and dispatch the product to your address. We reserve the right to decline or cancel any order (including after confirmation) due to pricing errors, stock unavailability, or shipping restrictions to certain US territories.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. Minors under the age of 18 are strictly prohibited from placing orders independently on this website.

  1. SHIPPING MODALITIES AND RISK

We operate under two distinct fulfillment models:

  1. In-Stock Items: Shipped from our third-party warehouses within the United States.
  2. Made-to-Order (MTO) Items: Products are manufactured upon your order and shipped directly from our production facilities in China via ocean freight.

Delivery Estimates: For MTO items, shipping timelines are estimates only. We are not liable for delays caused by international logistics, port congestion, or customs inspections.

Delivery Scope: All furniture deliveries are strictly “Curbside Delivery” only. This means the carrier will drop the shipment at the curb or the end of your driveway. While some local carriers may offer “Front Door” or “Inside Room” delivery as an optional service, Aspetra Limited does not guarantee, nor are we liable for, such premium services. Any additional fees for specialized handling requested by the customer at the time of delivery are the sole responsibility of the customer. The Customer assumes all physical risk, injury liability, and property damage risks during the transition of the product from the curb to the final indoor location.

Assembly: We do not provide assembly services. Customers are responsible for all product assembly. Improper assembly by the customer that results in product damage will void the warranty.

Risk of Loss: Risk of loss and title for items pass to you upon delivery to the address specified in the order. However, any loss or damage arising from the Customer’s failure to provide necessary customs information or pay taxes upon the shipment’s arrival at destination customs shall be the Customer’s sole risk.

Mandatory Inspection (The “48-Hour Rule”): Despite the transfer of risk upon delivery, your right to claim for transit damage is strictly conditional upon:

  1. Immediate Notation: You must inspect all packages at the time of delivery and write “DAMAGED” on the carrier’s Bill of Lading (BOL) if any visible damage to the packaging or product exists.
  2. 48-Hour Reporting: You must report any concealed damage or manufacturing defects to service@astorare.com with photographic evidence within 48 hours of receipt. Failure to comply with these two requirements shall constitute final acceptance of the product in good condition and will void any claims for transit damage.

In the event of any authorized return, the actual outbound shipping cost (initially waived) will be deducted from the total refund amount. For more detailed information regarding logistics, delivery zones, and customs procedures, please refer to our Shipping Policy.

  1. SAFETY WARNINGS AND USE RESTRICTIONS

CRITICAL SAFETY NOTICE: PLEASE READ CAREFULLY.

Not for Children or Pets: Our products are primarily made of natural marble and metal. Due to their extreme weight, fragility, and potential for sharp edges, they are NOT designed or intended for use in households with children or pets.

Tip-over & Injury Hazard: Heavy furniture poses a risk of serious injury or death if tipped over. You are solely responsible for the proper placement, stabilization, and (where applicable) anchoring of the product.

Assumption of Risk: By purchasing, you acknowledge these inherent risks and agree that Aspetra Limited shall not be liable for any injury or damage resulting from improper use, climbing, or failure to secure the products.

  1. PRODUCT CHARACTERISTICS

Natural Materials: You acknowledge that marble is a natural stone. Variations in color, veining, and texture are inherent characteristics and are not considered defects.

Handcrafted Nature: Minor variations in dimensions and finishes within reasonable tolerances are expected for handcrafted items.

  1. INSPECTION, RETURNS, AND CANCELLATIONS

Mandatory Inspection: Due to the fragile nature of marble, you MUST inspect the package upon delivery. Any damage must be reported with photographic evidence to service@astorare.com within 48 hours of receipt. Failure to do so constitutes acceptance of the product in good condition.

MTO Items: All made-to-order, custom, or bespoke products are final sale and are strictly non-returnable and non-refundable.

No Returns Except for Quality Defects: We do not accept returns or provide refunds for “change of mind,” aesthetic preferences, or any reason other than a verifiable manufacturing quality defect or shipping damage reported within the mandatory 48-hour window.

Authorized Returns: In the rare event a return is authorized due to a confirmed quality defect, the product must be returned in its original packaging. We reserve the right to provide a replacement or repair instead of a refund at our sole discretion.

  1. LIMITED WARRANTY

We provide limited warranty for two distinct fulfillment models:

  1. In-Stock Items: 1-year.
  2. Made-to-Order (MTO) Items: 2-year.

This warranty does not cover damage caused by improper assembly, misuse, or normal wear and tear.

  1. INTELLECTUAL PROPERTY RIGHTS

All content on the Website—including but not limited to product designs, proprietary marble textures/patterns, images, graphics, logos, trademarks, and text—is the exclusive property of Aspetra Limited or its licensors and is protected by international copyright, trademark, and intellectual property laws. Your use of the Website does not grant you any ownership or rights to our intellectual property. You may not copy, reproduce, republish, download, or use any content for commercial purposes or imitation of our designs without express prior written consent from Aspetra Limited.

  1. PRICING, SALES TAX, AND DUTIES

Sales Tax: For shipments within the US, applicable sales tax will be added at checkout based on your shipping destination.

Import Charges: For direct shipments from China, while we follow industry standards for customs declaration, any additional customs duties, import taxes, and local fees imposed by your state or local government remain your sole responsibility.

If the Customer refuses to pay the required duties or taxes, resulting in the shipment being held, returned, or destroyed by customs authorities:

  1. Termination of Delivery Obligation: Our obligation to deliver the product shall be deemed fulfilled and subsequently terminated. We shall have no further liability to complete the delivery.
  2. Non-Refundable Payment: All payments made by the Customer, including product costs and shipping fees, shall be strictly non-refundable as Liquidated Damages to offset international freight, storage, and administrative costs.
  3. Indemnification for Additional Losses: We reserve the right to pursue the Customer for any additional costs arising from their refusal, including but not limited to: customs storage fees, return freight charges, disposal fees, and administrative penalties imposed by authorities.
  4. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

Indirect Damages: In no event shall Aspetra Limited be liable for any indirect, special, incidental, consequential, or punitive damages (including but not limited to loss of use or loss of property).

Liability Cap: Our total aggregate liability for any claim arising out of or relating to these Terms or the purchase of products shall not exceed the actual amount paid by you for the specific product giving rise to the claim.

Legal Exceptions: Nothing in these Terms shall limit liability for death or personal injury caused by our proven gross negligence where such limitation is prohibited by law.

  1. BINDING ARBITRATION AND CLASS ACTION WAIVER (FOR US RESIDENTS)

Any dispute arising out of or relating to these Terms or the purchase of products shall be resolved through binding arbitration rather than in court. You and Aspetra Limited both agree to waive any right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.

  1. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute not subject to arbitration as per Section 9 shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.

  1. CALIFORNIA PROPOSITION 65 WARNING

WARNING: This product can expose you to chemicals including lead or other minerals present in natural stone and metal alloys, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information, go to www.P65Warnings.ca.gov.
