1. INTRODUCTION

These Terms and Conditions (“Terms”) govern the access to, use of, and purchase of products from the Astorare website (the “Website”) operated by Aspetra Limited, a company incorporated in Hong Kong (“we”, “us”, or “our”). By placing an order on this Website, you agree to be bound by these Terms. Our products are intended for personal, end-consumer use only.

2. ORDER ACCEPTANCE AND CONTRACT FORMATION

The display of products on the Website does not constitute a binding offer. A contract is only formed when we credit your payment and dispatch the product to your address. We reserve the right to decline or cancel any order (including after confirmation) due to pricing errors, stock unavailability, or shipping restrictions to certain US territories.

3. SHIPPING MODALITIES AND RISK

We operate under two distinct fulfillment models:

In-Stock Items: Shipped from our third-party warehouses within the United States. Title and risk of loss pass to you upon delivery of the goods to the carrier.

Made-to-Order (MTO) Items: Products are manufactured upon your order and shipped directly from our production facilities in China via ocean freight.

Delivery Estimates: For MTO items, shipping timelines are estimates only. We are not liable for delays caused by international logistics, port congestion, or customs inspections.

4. SAFETY WARNINGS AND USE RESTRICTIONS

CRITICAL SAFETY NOTICE: PLEASE READ CAREFULLY.

Not for Children or Pets: Our products are primarily made of natural marble and metal. Due to their extreme weight, fragility, and potential for sharp edges, they are NOT designed or intended for use in households with children or pets.

Tip-over & Injury Hazard: Heavy furniture poses a risk of serious injury or death if tipped over. You are solely responsible for the proper placement, stabilization, and (where applicable) anchoring of the product.

Assumption of Risk: By purchasing, you acknowledge these inherent risks and agree that Aspetra Limited shall not be liable for any injury or damage resulting from improper use, climbing, or failure to secure the products.

5. PRODUCT CHARACTERISTICS

Natural Materials: You acknowledge that marble is a natural stone. Variations in color, veining, and texture are inherent characteristics and are not considered defects.

Handcrafted Nature: Minor variations in dimensions and finishes within reasonable tolerances are expected for handcrafted items.

6. INSPECTION, RETURNS, AND CANCELLATIONS

Mandatory Inspection: Due to the fragile nature of marble, you MUST inspect the package upon delivery. Any damage must be reported with photographic evidence to service@astorare.com within 48 hours of receipt. Failure to do so constitutes acceptance of the product in good condition.

MTO Items: All made-to-order, custom, or bespoke products are final sale and are strictly non-returnable and non-refundable.

No Returns Except for Quality Defects: We do not accept returns or provide refunds for “change of mind,” aesthetic preferences, or any reason other than a verifiable manufacturing quality defect or shipping damage reported within the mandatory 48-hour window.

Authorized Returns: In the rare event a return is authorized due to a confirmed quality defect, the product must be returned in its original packaging. We reserve the right to provide a replacement or repair instead of a refund at our sole discretion.

7. INTELLECTUAL PROPERTY RIGHTS

All content on the Website—including but not limited to product designs, proprietary marble textures/patterns, images, graphics, logos, trademarks, and text—is the exclusive property of Aspetra Limited or its licensors and is protected by international copyright, trademark, and intellectual property laws. Your use of the Website does not grant you any ownership or rights to our intellectual property. You may not copy, reproduce, republish, download, or use any content for commercial purposes or imitation of our designs without express prior written consent from Aspetra Limited.

8. PRICING, SALES TAX, AND DUTIES

Sales Tax: For shipments within the US, applicable sales tax will be added at checkout based on your shipping destination.

Import Charges: For direct shipments from China, while we follow industry standards for customs declaration, any additional local use taxes or specific import fees imposed by your state or local government remain your sole responsibility.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

Indirect Damages: In no event shall Aspetra Limited be liable for any indirect, special, incidental, consequential, or punitive damages (including but not limited to loss of use or loss of property).

Liability Cap: Our total aggregate liability for any claim arising out of or relating to these Terms or the purchase of products shall not exceed the actual amount paid by you for the specific product giving rise to the claim.

Legal Exceptions: Nothing in these Terms shall limit liability for death or personal injury caused by our proven gross negligence where such limitation is prohibited by law.

10. BINDING ARBITRATION AND CLASS ACTION WAIVER (FOR US RESIDENTS)

Any dispute arising out of or relating to these Terms or the purchase of products shall be resolved through binding arbitration rather than in court. You and Aspetra Limited both agree to waive any right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.

11. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute not subject to arbitration as per Section 9 shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.

12. CALIFORNIA PROPOSITION 65 WARNING

WARNING: This product can expose you to chemicals including lead or other minerals present in natural stone and metal alloys, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information, go to www.P65Warnings.ca.gov.

1. Free Standard Shipping (U.S. Only)

We are pleased to offer Free Standard Shipping for all orders delivered within the contiguous United States.

Scope of Waiver: This free shipping policy applies strictly to the initial base transportation cost from our shipping origin (U.S. warehouse or China production facility) to your designated delivery address.

Exclusions: This waiver does not cover expedited shipping, white-glove service, specialized handling, or any additional fees imposed by local authorities.

2. Shipping Methods

Astorare utilizes a strategic fulfillment model based on inventory location:

U.S. In-Stock Items: Dispatched via domestic freight or courier services from our third-party warehouses within the United States.

Made-to-Order Items: Produced upon order and shipped directly from our facilities in China via professional ocean or air freight.

3. Duties, Taxes, and Import Charges (Sole Customer Responsibility)

While the base shipping is free, all additional government-mandated or carrier-assessed charges must be borne entirely by the Customer.

• Sales Tax: Applicable state and local sales taxes for U.S. deliveries will be calculated and collected at checkout.
• Import Duties & Fees: For products shipped directly from China, you are the “Importer of Record.” You are solely responsible for all customs duties, import taxes, VAT, GST, brokerage fees, or other charges assessed by U.S. Customs and Border Protection or local authorities.
• Outside Our Control: These charges are determined by local regulations and are outside the control of Aspetra Limited.

4. Delivery Terms (DAP)

Unless otherwise agreed in writing, all international shipments are made on a Delivered At Place (DAP) basis.

Our Responsibility: We arrange and pay for the base transportation to your address.

Your Responsibility: You are responsible for import clearance and the payment of all applicable duties, taxes, and local handling charges upon arrival.

5. Delays & Customs Clearance

All delivery timelines provided at checkout or via email are estimates only. Astorare shall not be held responsible for delays caused by:

• Customs clearance procedures or governmental inspections.
• Local carrier operations or regional logistics disruptions.
• Force majeure events (including but not limited to weather, strikes, or maritime accidents). We are not liable for any consequential losses arising from delivery delays beyond our reasonable control.

6. Failed Delivery & Additional Costs

Any additional fees, penalties, or storage charges resulting from the following shall be borne solely by the Customer:
• Incorrect Information: Providing inaccurate or incomplete shipping addresses or contact details.
• Refusal of Payment: The Customer’s refusal to pay applicable import duties, sales taxes, or customs fees.
• Failed Delivery Attempts: Inability of the carrier to complete delivery after multiple attempts or failure of the Customer to coordinate with the carrier. In the event of a return due to the above reasons, all return shipping costs and a 25% restocking fee will be deducted from any potential refund.
